How long do I have to file a workers’ comp claim?

You have three years from your injury in California to file a claim. However, there can be exceptions to this rule. For example, the statute of limitations could be extended if:

  • You don’t notice your injury right away (typically for repetitive stress injuries)
  • Your injury involved a contagious illness and you had to quarantine
  • Your employer or the insurer are caught trying to defraud you out of benefits

There may also be instances where the statute of limitations for these cases can be reduced. For example, if you are the loved one of someone who died in a workplace accident, you may only have one year from the date of the incident to pursue a claim. 

Can I see my doctor after a workplace injury? 

Yes, you can typically see your doctor after a workplace injury in California. However, your doctor must be “predesignated” with your employer, meaning you gave a written notice to your employer naming the physician you would like to use if you get hurt on the job.
